Conditions of Sale
The following Conditions of Sale govern, together with our Terms and Conditions, Return Policy, and Privacy Policy, the offer and sale of products on CAPOSERIO.COM.
Items purchased from our website are sold directly by Caposerio S.a.s (the Seller), with registered office in Via Roma 18, 90015, Cefalù (PA), Italy, and VAT no. 04132890825.

1. Eligibility for purchase
To place an order on our website, you must:
a) at least 18 years old;
b) provide your personal information (your full name, landline/mobile number, and email address);
c) provide your delivery/billing address;
d) own a valid payment method accepted by our website.
Once the transaction is complete, you will then return to the order confirmation page on CAPOSERIO.COM. Payment will be debited from your account upon dispatch of your order.
By completing the transaction, you confirm that the card that is being used for payment is yours or that you have been specifically authorised by the owner of the card to use it. All card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to www.caposerio.com, we will not be liable for any delay or non-delivery.
We take reasonable care to make our website secure; all card transactions are processed using a secure online payment gateway that encrypts your card details in a secure host environment.
If you have registered with our website, we will securely store your card details on our systems. These details will be fully encrypted and only used to process card transactions which you have initiated.
2. Our business policy
These Conditions of Sale apply exclusively to the products offered by CAPOSERIO.COM and any order submitted on and accepted by our website, as well as the relationship between users and the Seller.
The website is available only to individuals and others who meet the terms of eligibility of CAPOSERIO.COM, who have been issued a valid payment card by a bank acceptable to CAPOSERIO.COM, and who have authorized CAPOSERIO.COM to process a charge or charges on their card in the amount of the total purchase price for the merchandise which they purchase. Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit.
The Seller will not accept transactions or deny any service if such transactions and services do not comply with our business policy, or in the event that the Seller suspects or reports fraudulent or illegal activity. We will not be held responsible for refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
3. Purchase and acceptance of orders
To place and submit an order on our website, users must:
a) add items to cart;
b) provide all requested data;
c) choose the best shipping option for you;
d) select a payment method.
All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.
Before you submit your order, we will draw your attention to our Conditions of Sale, which we recommend that you read very carefully. You can print, keep or duplicate a copy for your personal use only.
The order form will sum up all the information regarding the specific feature of each product you have purchased, the sale price (including taxes and duties), shipping details and fees, return instructions, and the conditions you must meet to exercise your right of withdrawal.
We will retain your order form in our database for as long as required to process orders and, in any case, in full respect with the law. To view your order form, log in to your Account and consult the “My Orders” section.
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.
Once your order is ready to departure our warehouse, you will receive an email stating that your order has been shipped.
Unless otherwise agreed, your order will be delivered within 30 days of the order confirmation date. If we are unable to deliver your order within this period of time, we reserve the right to cancel your order and fully refund you.
When you click on the “Submit order” button, you provide CAPOSERIO.COM with the consent to process your order as requested.
We reserve the right not to accept your order in the event that:
a) one or more items in your order are out of stock;
b) we are not able to process payment or the payment method you have selected has been denied;
c) an error with the price or the item description might have occurred;
d) your order does not meet our/your local import restrictions;
e) your order does not meet eligibility requirements or our Terms and Conditions.
In the event that we are not able to accept your order, our Customer Service Team will reach out to you as soon as possible.
4. User rights, pricing policy, products, and restrictions
4.1 CAPOSERIO.COM offers products belonging to different brands and purchased directly from the company representing such brands.
4.2 The Seller does not sell second-hand products, flawed products, or products of lower quality than the corresponding market standards.
4.3 Each product sold on our website is associated with an informative sheet describing all the features. Occasionally, colors may differ from the images shown on the website due to your computer/device screen resolution or settings.
4.4 Prices for products on our website may change. Please make sure you check the final sale price before submitting the order form.
4.5 The Seller reserves the right to deny any purchase request coming from places he cannot ship orders to.
4.6 All products come with a designer tag and a disposable seal. If you are not sure you are keeping the items you purchased, please DO NOT remove them.
4.7 The seller reserves the right not to accept returns if the designer and disposable tag are not attached to the product(s) (please note that such tags constitute an integral part of each product), or if products show signs of wear or have been used or altered from their original condition in any way. As an alternative, we may reduce the amount of any applicable refund or exchange accordingly. For further information, please refer to our Return Policy notice.
The legal guarantee of conformity in Italy protects consumers from defective products, and applies to most products and services sold. This guarantee is set out in Articles 128 et seq. of the Italian Consumer Code. In accordance with the applicable law, users can exercise the following rights:
a) all products purchased from CAPOSERIO.COM must be of satisfactory quality, fit for purpose and as described;
b) users benefit from a legal guarantee of conformity of 2 years, which allows you to ask the Seller to repair or exchange the good(s). The user is required to contact our Customer Service Team within a period of two (2) months from the detection of the defect. Consumers can choose between repair or replacement of a product if it lacks conformity, during the legal guarantee period.
If such options are not available, users have the right to request a reasonable reduction in the price or to withdraw from the purchase contract.
5. Payment methods
If you purchase from www.caposerio.com, you can select one of the following payment methods:
a) credit/debit/prepaid card;
b) PayPal;
c) cash on delivery;
d) bank transfer;
e) Scalapay: this payment method allows you to split your purchases into three interest-free installments. Once you have placed your order, you will be redirected to Scalapay. To complete the transaction, you will need to log in to your Scalapay account or create one. The payment will be confirmed within a few seconds and your order will be processed immediately. By selecting this payment method, you accept the Terms and Conditions of Scalapay;
f) Klarna: this payment method allows you to split your purchases into three interest-free installments. Once you have placed your order, you will be redirected to Klarna. To complete the transaction, you will need to log in to your Klarna account or create one. The payment will be confirmed within a few seconds and your order will be processed immediately. By selecting this payment method, you accept the Terms and Conditions of Klarna.
6. Gift Card
6.1 By purchasing and using a CAPOSERIO gift card, Customers confirma their acknowledgement and acceptance of these Terms and Conditions without any reservation.
6.2 Gift cards are prepaid cards; they cannot be refunded or exchanged for cash, and do not earn interest. They are not intended in any way as an investment tool and/or a solicitation to save.
6.3 Gift cards can only be used online for purchasing any single item sold on CAPOSERIO.COM.
6.4 Customers are allowed to choose the value of gift cards, either from a set of specific options or by entering a custom amount. CAPOSERIO.COM offers gift cards with a minimum value of €50 up to a maximum value of €3,000, and can be used as a complete or partial payment.
6.5 Gift cards are valid for 12 months from the date of purchase, and there are no limitations on how many times they can be used (until the balance is €0.00). Once gift cards have expired, they cannot be renewed or used to purchase goods. If you do not spend the entire balance on a gift card, the remaining balance will not be refunded or returned in any form.
6.6 Gift cards are validated after payment has been completed successfully and shall be considered officially activated when both the purchaser and the redeemer receive a confirmation email. CAPOSERIO.COM allows you to choose the day and time to send an email gift card: you can select a future date or send it immediately, or even share the gift card details by any other means.
6.7 Gift cards contain a unique code that identifies the card and allows it to be redeemed on CAPOSERIO.COM. When you enter a gift card code at checkout, the cart will be automatically updated to deduct the gift card amount from the total. If a purchase exceeds the redeemer’s gift card balance or value, the remaining amount must be paid with another payment method accepted on CAPOSERIO.COM.
6.8 Orders placed using gift cards can be returned; any money owing to you will be refunded via the gift card originally used for such purchase. If you choose to return an order paid partly with a Gift Card and partly with another payment method, you will receive a mixed refund. For example, if you place a €100 order using a €50 gift card and a credit card to integrate the remaining €50, we will refund both payment methods, excluding possible shipping/return fees (for further information, please read through our Return Policy notice). Please note that CAPOSERIO.COM will not offer store credit as a refund option for gift card orders.
6.9 Gift cards purchase is also a chance to upgrade your Loyalty Program status: you can earn points when buy a gift card (1€ = 1 point).
6.10 You can check your gift card balance at any time, until it expires.
6.11 CAPOSERIO.COM shall not be liable or responsible for the loss, failed activation or late delivery of gift cards. CAPO SERIO di F. Serio S.a.s. is exempt from any responsibility in case of force majeure events such as, by way of example and not limited to: (i) poorly functioning or interrupted telecommunication systems, (ii) a delay in the transmission of information or data, or the loss of such information or data that may occur for one of the causes previously described, (iii) inaccurate gift card data provided by the purchaser, (iv) mail delivery failure, (v) spam or junk mail detection.
6.12 CAPOSERIO.COM reserves the right to refuse or cancel any gift card obtained through illegal or unauthorized means and will report fraud to authorities.
6.13 Gift card holders cannot use their cards for advertising or promotional purposes of the goods marketed by CAPOSERIO.COM, unless the company authorizes such activities.

7. Shipping and delivery
7.1 Shipping fees
Shipping fees and free shipping threshold vary by country. Here you can find the explanatory table.
7.2 Delivery
CAPOSERIO.COM ships to selected countries in Europe and relies on UPS, DHL and BRT (the latter exclusively for shipments to Italy).
Items available in our warehouse are shipped within 1-2 business days from Monday to Friday from the date of the order.
Shipments normally take 2 up to 5 business days, but may vary according to the country of destination. However, delays may occur due to inclement weather or during busy shopping periods like Black Friday and Christmas due to high demand. The Seller is not liable for shipping delays that are beyond their control.
Shall you need to consult your shipping information, including the tracking number, please log in to your Account, refer to the ‘My Orders’ section. If you placed an order as a guest, you will find your order details in the ‘Orders and Returns’ section: you will be requested to enter your order number and your email address.

In particular, we wish to draw your attention to this Notice as the information contained therein account for an integral and fundamental part of these Conditions of Sale and, therefore, is deemed to be fully known and accepted by you when the order form is being transmitted.
8. Customer Service

9. Withdrawal
9.1 You are entitled to withdraw from the contract with the Seller, without any penalty and without providing a reason, within 14 working days from the date of receiving your parcel. It is NOT possible to return an item and exchange it with another one.

We advise you to read this section very carefully. The information provided forms an integral part of our Conditions of Sale and, consequently, shall be deemed to be fully read and accepted by users when sending the order form.
10. Legislation
Our Conditions of Sale are governed by, and established in accordance with, Italian laws, and specifically the Italian Consumer Code (Legislative Decree 206 of September 6, 2005) and Legislative Decree 70 of April 9, 2003, which covers e-commerce.
11. Amendments and updates
Our Conditions of Sale may change from time to time due to new regulations or for other reasons. The new Conditions of Sale will be effective as of the date of the new publication on CAPOSERIO.COM.
